Status of these terms and conditions and updates

These terms and conditions, together with our Privacy Policy and Copyright Policy, will form a legally binding agreement between you and London Bridge College in relation to your use of the London Bridge Colleg website. By using London Bridge College website, you confirm that you accept these terms and conditions and that you agree to comply with them. If you do not agree to these terms and conditions, you must not use London Bridge College website.

This version of the London Bridge College terms and conditions supersedes all prior, written or oral understandings or agreements and applies to the exclusion of any other terms or conditions that you may seek to impose or incorporate, or which are implied by law, trade, custom, practice or course of dealing. We may update these terms and conditions from time to time. Any changes to these terms and conditions will be displayed on the London Bridge College website and your continued use of the website indicates your agreement to these changes. Accordingly, please check this page from time to time to take notice of any changes we made, as they will be binding on you.

Nothing that you see or read in the Products may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use. All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorised use is prohibited.

Non Transference and Modifications

  1. London Bridge College Online learning user is allocated to a particular named individual and such allocation once made cannot be transferred to any other named individual.

Cancellations

Courses purchased cannot be cancelled and may not be transferred to other individuals.

LBC Responsibility for loss or damage

London Bridge College is not liable to you in any way for any indirect, special, incidental, punitive or consequential damages of any character, including without limitation damages for loss of goodwill, work stoppage, computer failure or malfunction, loss of data, loss of productivity or contract or any and all other commercial damages or losses. Not excluding or limiting our liability to you in any case where it would be unlawful to do so. London Bridge College will not be liable for damage which you could have avoided by following our advice, following installation/download instructions, or having in place the minimum system requirements as advised by us.

London Bridge College is not liable for any damage to your computer system or loss of data resulting from the downloading of content during the course duration.

Links to Third Party Sites

London Bridge College website or LMS Platform may present links to third party websites not owned or operated by London Bridge College. London Bridge College shall not be responsible for the availability of these sites or their content. The College shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the user’s use of or reliance on any content of any such site or goods or services available through any such site.

Copyright and Proprietary Property.  

We will provide to you manuals and other material, which are copyrighted proprietary property of London Bridge College. You will also receive additional materials that are the copyrighted proprietary property of third parties. All copyrights relating to any course materials provided or made available by us or any other party remain the sole property of the holder of the copyright. Therefore, no part of any course materials may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, or translated into any language, without our prior written consent.

Compatibility

The LMS Platform is supported on most web browsers and mobile devices. It is the User’s responsibility to ensure compatibility of software. You will be fully charged in the event of failed access due to incompatible software and/or devices.

Payment

The Course Fee for any Online Course at any given time and any additional delivery charges payable in relation to the delivery of Course Materials, if applicable, will be displayed on the Website and/or in a Brochure and/or will be notified to you by a London Bridge College customer services representative.

All amounts are payable in Pounds Sterling.  Any currency conversion costs or other charges incurred in making a payment shall be borne by you, and shall not be deductible from the amounts due to London Bridge College.

Unless otherwise specified in respect of a particular Online Course, the Course Fee is payable either:

  • with a one-off lump-sum payment, payable with your purchase offer; or
  • in instalments, with payments being due at certain times over a set period of time, as specified on the Website and/or in a Brochure and/or as notified to you by a London Bridge College customer services representative, with the first instalment being payable with your purchase offer.  Subsequent instalments will be automatically deducted from the debit/credit card you used to pay for the first instalment.

By choosing to pay the Course Fee in instalments, you agree that:

  1.  it is your responsibility to ensure that the instalment payments are made on the due dates;
  2. London Bridge College and/or its service providers are authorised to collect the instalment payments from the debit/credit card you used to pay for the first instalment when such instalments become due and payable;
  3. you will inform us by email at info@london-bridge-college.com if you change your debit/credit card or if your debit/credit card expires or is no longer valid prior to your next instalment becoming due and payable;
  4. any failure to make payment of an instalment when due and payable constitutes a breach of the Contract and:

  6. without prejudice to any other rights it may have, London Bridge College may suspend or cancel your access to the online course until the remaining instalment amounts are paid in full;
  7. where London Bridge College takes action, you will not be entitled to a refund of any amount already paid

Technical Support and Access

If you are unable to access an online course, London Bridge College will use reasonable endeavours to provide a solution where London Bridge College has direct control over the system, software or settings involved. If the issue lies with your hardware, systems, software or settings thereof, London Bridge College may, in its discretion, provide assistance to you to help you resolve the issue but we cannot guarantee that any assistance provided will resolve your issue.

 You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the Website and that technical assistance may not be available during such periods of downtime.  Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.

London Bridge College will use reasonable endeavours to make the Online Course available but cannot guarantee uninterrupted, timely or error-free availability or that defects will be corrected.  London Bridge College reserves the right to suspend access to the Website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or functionality of the Website.

You also accept and acknowledge that London Bridge College cannot be held responsible for any delay or disruptions to your access to the Online Course as a result of such suspension or any of the following:

  • the operation of the internet and the world wide web, including but not limited to viruses;
  • any firewall restrictions that have been placed on your network or the computer you are using to access the Online Course;
  • failures of telecommunications links and equipment; or
  • updated browser issues.

OTHER IMPORTANT TERMS

Governing law

These terms are governed by and construed in accordance with the laws of England and Wales and you can bring legal proceedings in the English courts.
